Software License Agreement between University of Magdeburg Universitaetsplatz 2 39106 Magdeburg Germany (refered to as License Provider below) and any Licensee under the conditions of this agreement. Licensee can be any private individual, educational institution or public research institute. By installing the software the Licensee agrees to the conditions of this agreement. This License applies to the simulation development environment Create! refered to as "Create!" or "the software" below. Within the scope of this license "Create!" or "the software" refers to the - Create! environment consisting of the virtual image and it's Smalltalk changes - library of types and elements with their SEC and ParSEC source code - library of icons - manuals and tutorials including the tutorial models or parts of the above. The software is licensed free of charge for strict non-commercial purposes within the restrictions stated below. The Licensee may not charge a fee for distribution, application or hiring of the software to third parties in the context of contracts for the performance of a continuing obligation. All property rights, including the particular right to amend, revise, or copy the program are retained by the License Provider. The software contains confidential, unpublished information, which is protected by copyright or trademarks. All original copyrights and trademarks belong to FhG-IML Josef-von-Fraunhofer-Str. 2-4 44227 Dortmund Germany Warranty: Because the software is licensed free of charge, there is no warranty for the software, to the extent permitted by applicable law. The software is provided "as is" without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk to the quality and performance of the software is with the Licensee. Should the software prove defective, the Licensee assumes the cost of all necessary servicing, repair or correction. In no event unless required by applicable law or agreed to in writing will the License Provider will be liable to the Licensee for damages, including any general, special, incidential or consequential damages arising out of the use or inability to use the software (including but not limited to loss of data or data being rendered inaccurate or losses sustained by the Licensee or third parties or a failure of the software to operate with any other software), even if the License Provider or other party has been advised of the possibility of such damages.
