In a strict English sense delay relates to time, whereas
latency relates to relates to an outcome which
has yet to be observed (not necessarily due to
a delay in time).

I would argue that this is reflected in typical Engineering
usage.  Delays typically refer to asynchronous phenomena,
while latency is typically used in relation to synchronous
phenomena.

For example, it is common to talk about the
propagation delay of a gate.  Propagation delay
is normally expressed in units of time.
Latency is often expressed in terms of clock cycles,
which are one step removed from units of time,

It's a subtle difference, but if you think
about it, it's probably the way most people
apply the terms.  Then again, I'm sure there
are plenty of exceptions and people who use
the terms interchangeably.
